Academic career
Mooney joined the University of Oregon School of Law faculty in 1972, after working with Howard, Prim, Rice, Nemerovski, Canady & Pollak in San Francisco, specializing in commercial litigation before federal and state courts and administrative agencies.[1]
Transitioning from private practice to academia, Mooney gained international attention[2] from the publishing of his article "The New Conceptualism in Contract Law".[3] The article, said one writer, "forthrightly condemns and carefully documents the broad resurgence of a style of judicial reasoning that, throughout a range of issues in contract law, exalts wooden logic at the expense of factual and interpretive nuances, all with 'profoundly conservative political implications.'"[4]
Mooney is also a leading authority on 19th century Oregon legal history.[5] His major work in progress is a judicial biography of Matthew Deady, Oregon's first federal district judge, portions of which have been printed elsewhere.[6]
In addition to having taught at the University of Oregon School of Law for the past 37 years, Mooney spent his last two sabbaticals teaching at Victoria University of Wellington, New Zealand and University of New South Wales in Sydney, Australia.[1] He also has made two extended trips to Ukraine and one to Georgia to teach judges, lawyers, and law students about American contract and commercial law.[1]
