Since 1988, Brazil adopts a system in which the prosecution and the representation of the State are no longer concentrated in only one institution. Therefore, the Attorney General of the Union (Advogado-Geral da União, in Portuguese) , with the assistance of his Office (Advocacia-Geral da União, in Portuguese) , is the authority in charge of the legal advising of the Executive Branch and the judicial and extradicial representation of the State of Brazil. The current Attorney-General of the Union, and head of the Office of the Attorney-General of the Union, is Luís Inácio Adams.

The General Prosecutor in Brazil (Procurador-Geral da República, in Portuguese) is the head of the Brazilian Federal Prosecution Office, called "Ministério Público da União", an autonomous agency in charge of criminal prosecution and the defense of society in general. The General Prosecutor heads a group of independent prosecutors, called Procuradores da República, who work to investigate and prosecute criminal, labor and civil offenses committed against society. It is a position appointed by the President of the Republic and the nomination must be approved by the Federal Senate. The current General Prosecutor of Brazil is Roberto Gurgel.
