Although this image is subject to copyright, I feel that the fair use provisions of U.S. copyright laws cover its use because:

1. The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes – Free images of Brewster are difficult to obtain. Its inclusion in the article adds significantly to the article because it depicts a historical figure in an article without other images of the subject of the biography. The use is for informational purposes through a non-profit entity.
2. The nature of the copyrighted work – The image is obtainable at the Yale University Office of Public Affairs Image Database website (http://128.36.236.90/res/sites/opa/). It is a 48 KB JPG image.
3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole – This image is not part of a larger, copyrighted work.
4. The effect of the use upon the potential market for or value of the copyrighted work. – Many images of Brewster are visible on the web, but there are none apparently in the public domain. Use of this image in the Wikipedia article entry on Brewster does not diminish the economic benefits that would accrue to Yale University or any other party. This one image would have a negligible effect on its overall market potential, since it contains only 48 KB, which gives it poor potential for reproduction.
