- It is believed that the use of this mugshot on the English-language Wikipedia to illustrate the activities engaged in by Roeder while he was allegedly a member of the Montana Freemen, which led to his arrest, in the "Assassination of George Tiller" article falls under the "Non-profit educational" clause of the Fair Use doctrine currently upheld by United States law. (17 U.S.C. § 107)
- The image is irreplaceable; a free analogue is impossible to produce as the original will be covered by copyright for the foreseeable future.
- A low resolution of the original image is used, therefore the portion of the copyrighted work used is of inherently lower quality than the original, reducing the risk of competitiveness and therefore the effects of this copy on the market for or value of versions held by the owner of the copyright.
- The images is used on various news websites, so its use on Wikipedia does not make it significantly more accessible or visible than it already is.
- The image is being used in an informative way and should not detract from the original mugshot, nor does it imply endorsement of the article in question by the image's original author.
- The image is significant since it was taken during the arrest for the act being depicted, which allows for greater precision and illumination of commentary as afforded by its visual identification of the participant.
