I believe this image to be out of copyright. It is a portrait taken by a local commercial photographer in approximately 1900 and I am certain that the firm no longer exists. I believe its use to be covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies. It is being used for informational purposes only and has been uploaded solely to illustrate a biographical article on the subject. In my view, its inclusion significantly enhances the article by providing readers with a photograph of the man they are reading about. It is of lower resolution than the original so copies made from it will be of inferior quality.
