• No free equivalent is reasonably possible since the subject has died
• As this is a mugshot photo, it was intended for wide distribution, and its use here does not diminish the copyright holder's ability to sell the photo.
• The whole image is used, but it is of low-resolution, to maximize its commercial viability
• This image has widely been released and published in the media
• It meets all content standards and is encyclopedic as it illustrates the subject
• It is used to illustrate the Troy Davis article
• Illustrating the appearance of the subject provides reader information cannot be replaced by anything other than the image itself

This media is a booking photo, more commonly known as a mug shot, normally produced in the regular operations of a law enforcement agency or correctional facility.
