Lesbian, gay, bisexual, and transgender (LGBT) persons in Benin may face legal issues not experienced by non-LGBT residents. Same-sex sexual acts for both men and women are legal in Benin, though same-sex couples and households headed by same-sex couples are not eligible for the same legal protections available to opposite-sex couples.[1]

Same-sex sexual acts are legal in Benin.[1] Same-sex sexual acts were previously illegal for both men and women, with a penalty of between one and three years in prison and a fine between 100,000 and 300,000 francs (150 to 300 euros).[2]

There is no recognition of legal rights for same-sex couples.[3]

There is no legal protection against discrimination based on sexual orientation.

The U.S. Department of State's 2010 Human Rights Report found that "there were no reports of overt societal discrimination or violence based on a person's sexual orientation" in Benin.[4]
