Fiske was specially appointed by Janet Reno as when the Whitewater allegations first surfaced the Act had lapsed. Fiske was legally under the control of the Justice Department. When the Act was re-enacted, Reno asked the Special Division to appoint a prosecutor under the Act: that resulted in the Starr appointment.
