This article has several shortcomings in the discussion of the Longueira Law (plus other mistakes, and strong bias).

In particular, the article fails to specify that there are three categories of fishing vessels in Chile: industrial, semi-artisanal (medium sized of up to 18 meters length and 80 cubic meters of storage capacity) and artisanal (open boats less than 12 meters in length, often shore based). The last two categories are defined as artisanal, though there is a lrge difference in fishing capacities, and the owners of semi-artisanal vessels can be fairly wealthy.

Contrary to the article, in Chile the industrial fleet cannot fish in 5 mile zone, except in rare cases where there are no semi-artisanal or artisanal vessels with fishing permits in an area. This has been true since the 2001 Fishing Law, and was reaffirmed in the Longueira Law. The semi-artisanal fleet can operate within the 5 mile zone, but the first mile is exclusively for artisanal boats. This created a conflict because before the Longueira Law, the semi-artisanal fleet was allowed into the first mile.

"La pesca artesanal tiene reservadas las primeras cinco millas para realizar su labor, llamada Área de Reserva para la Pesca Artesanal. Además, la nueva Ley de Pesca establece la primera milla marítima para el uso exclusivo de embarcaciones de menos de 12 metros de eslora, desde el límite norte del país hasta el límite sur de la isla de Chiloé, modificación que entrará en vigencia en febrero de 2014.", [1].
