Oh Ok but in the news article http://www.foxnews.com/world/2014/09/02/ukraine-shifts-tactics-against-rebels-while-claiming-full-scale-invasion-by/ it says that Russian has to fight Russian troops which means it is fighting Russia which means it has to declare war.
