It is considered that it is a fair use of a low resolution image to accompany an article on the artist, Tracey Emin. The work is an important and well known piece of art that has attracted much public attention and is considered by the artist to be one of her two major and "seminal" pieces of work. It is considered that the image significantly aids the understanding of the topic, and this would be impaired without it. It was destroyed in the 2004 Momart warehouse fire; thus no new photographs of it can be taken. It is believed that this use does not infringe copyright. There is no known free alternative available. According to section 107 of the United States Copyright Act of 1976: The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.
