Article | |
Portion used |
Black border cropped for article formatting, however, the entire image is shown to avoid misrepresenting the intended image. |
Low resolution? |
The image has been sized to be as small as possible, while providing the reader with a reasonable idea of the characters' appearance. |
Purpose of use |
The image is being used for educational purposes within the text passage(s) of the Kool-Aid Man article on Wikipedia. There is an image of the modern-day animated version of the mascot used in the article, however, the modern-day "cartoon" mascot does not adequately convey the appearance of the original live-action Kool-Aid Man (which has been repeatedly referenced in modern-day pop culture, most notably on the animated television series Family Guy). The significance of this particular image is to illustrate the original live-action Kool-Aid Man's appearance, his trademark "entrance" (breaking through walls), and to illustrate General Food's intended branding during the 1970s, in a way that words alone could not convey. Also see rationale below. |
Replaceable? |
Advertising mascots are always presumed to be non-free, therefore, a free-use alternative won't exist. |
Other information |
This image was originally copyrighted by General Foods and the mascot itself is now believed to be the property of Kraft Foods, yet it is believed to be covered by United States fair use laws because:
