I have permission from the author (Silvano de Gennaro e-mail: AT but he doesn't want the picture to be released under a free license because the subjects want to retain control of their image. Below are quotes from the e-mail discussion between me and him (which I can make available in full on request):

"I want to place the picture of the Cernettes at on Wikimedia Commons ( so I can use it on an article I wrote on the Dutch Wikipedia (which doesn't allow fair use as that is not legal in The Netherlands). Could you provide me with legal permission by the author to use that picture (by stating his or her permission via e-mail)?"

"As author of the photo and owner of the Cernettes intellectual property rights, I authorize you to use the "first picture on the web" of the Cernettes, for your article on Dutch Wikipedia.
Silvano de Gennaro"

"Could you send an e-mail containing the below to the mentioned address and also forward it to me? It was mentioned to me that a free license has to be agreed to for the image to be used on Wikipedia. Sorry for not mentioning that. I filled in the form for your behalf. If the license type is not OK you can select a different one from this page"

"I am sorry but the girls want me to keep control over the usage of their image, and would not allow any modifications to the photos, so I have to grant permission requests on a 1 by 1 basis and cannot allow any of the commons licenses.

"Sorry to hear that. I can't use it on and the Dutch wikipedia then but I can put it in the article at the English wikipedia as they allow fair use with the present copyright status unchanged. Is that ok with you?"

"yes, that is ok.

When I asked him about a date for the picture's upload to the web I got the following response:

"I don't think there is actually a date. I gave the photo to Reinard, who was working with Tim in July '91. At the time the web was a prototype, and only a few people were using it. Reinard and the others played with that photo during the development of the software interface to display photos. So it's been on and off the web for a few months, until one day the GIF interface worked fine and the photo stayed on the server and became accessible to the other surfers. I don't know exactly what date that would be, and I doubt anyone does. Another thing is that I believe that interface (XV) was originally only developed for Unix. I know that because I helped develop a similar one for VAX/VMS a few months later.
