How did the marriage of Glaphyra and Herod Archelaus violate the law of Levirate marriage?[edit]

It seems to me that Herod Archelaus was within the law as I read it in Deuteronomy 25. Am I missing something? Since this event occurred between 6 BCE and 6 CE, the answer can't be that he was violating the Talmud, which wasn't begun until the Yeshivas were established in Galilee in 70 CE.
