Australian referendum, 1913 - The cases referred to by the Attorney-General were:[1]
  • Cunningham v Commonwealth [2016] HCA 39 changes to the retiring allowances and life Gold Pass for retired members of Parliament were not an acquisition of property otherwise than on just terms.
  • Caledonian Collieries Ltd v Australasian Coal & Shale Employees' Federation (No 1) [1930] HCA 1 and (No 2) [1930] HCA 2 held that attempts to arbitrate a management lockout in Hunter Valley coalmines were invalid as the dispute did not "extend beyond the limits of any one State".& role of Chief Justice Knox in inheriting the property and business of Mr John Brown, a coal magnate who was involved in the bitter lock-out of 12,000 coal miners who were left without an income in the midst of the Great Depression.   • 1972 National Wage and Equal Pay Cases 1972 (1972) 147 CAR 172] – Commission - The second of the two major Equal Pay Cases provides for equal pay for work of equal value. Before 1972 male and female jobs are compared to see if they are basically identical. After 1972 work is compared to see if it is very similar in content or tasks. Some employers seek to avoid the equal pay rulings by reclassifying, or renaming, women's jobs. This is particularly widespread after the 1972 decision, with one survey finding that over 60 per cent of employers have reclassified women's jobs onto a different (and lower) scale to men in similar work.   • 1969 Equal Pay Case Equal Pay Case 1969) (1969) 127 CAR 1142 – Commission - First of the two major equal pay cases. Before this time women's wages are set substantially lower than that of their male equivalent (on the basis that the male basic wage contains a 'breadwinner' component not applicable to women). The introduction of equal pay is prompted by a number of factors, including the ILO Convention on Equal Pay, increasing female employment, and the abolition of the Basic Wage in 1967. The 1969 decision grants 'equal pay for equal work'—where women perform 'equal work' alongside men they should receive equal pay. The Commonwealth Conciliation and Arbitration Commission rules, however, that equal pay is not applicable 'where the work in question is essentially or usually performed by females but is work upon which male employees may also be employed'. By the time of the 1972 equal pay case, figures are produced to show that only 18 per cent of women workers have benefited as a result of the 1969 decision
  • 1966 Cattle Station Industry (Northern Territory) Award, 1951 (1966) 113 CAR 651 - Commission - Cattle Industry Case – equal pay for Aboriginal stockmen - Aboriginal stockmen in the Northern Territory are awarded equal pay with white workers when their union successfully applies for the deletion of clauses excluding them from the Cattle Station Industry (Northern Territory) Award. The decision affects 'full-blood' Aborigines as those of 'mixed-blood' are treated as white. The Commonwealth Conciliation and Arbitration Commission agrees with employers that many Aborigines are unable to work on cattle stations in a way normally expected in Australian society. It rules, however that: 'There must be one industrial law, similarly applied, to all Australians, aboriginal or not'. The Commission provides a lengthy period for implementation, its order not coming into effect until some 33 months later.

  • 1947 Forty Hour Week case (1947) 59 CAR 581 - Arbitration Court - Standard hours of work are reduced from 44 to 40 hours per week as a result of a 21-month-long inquiry. While employers argue against shorter working hours, the claim is not opposed by any government-state or federal. The Commonwealth Court of Conciliation and Arbitration considers a range of factors and evidence including the effect of shorter hours on production, costs and prices, the validity of the claim for extra leisure and the state of the Australian economy. The new standard does not apply to rural employees but is generally applied Australia-wide by early 1948.
