This image is clearly a copyright violation. The picture was taken for Rolling Stone Magazine. It is being use in an article about The Carpenters. There is no indication that Rolling Stone Magazine has released this image to be used in Wikipedia.

It should be noted that fair use statements have been updated, but I still question the legality of using this image as there is no indication of the copywrite holder has released the image and the use does not appear to fall into the category of "fair use".
The license being used states:
This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media.
yet the source indicated is:
Annie Leibowicz, Rolling Stone magazine
