Location and General Description of Property

The railroad of the Elkhorn & Beaver Valley Railway Company, herein called the Elkhorn & Beaver Valley, likewise leased to and operated by the carrier [Chesapeake and Ohio Railway], is a single-track line, extending from Beaver Creek to Wayland, Ky., a distance of 20.746 miles.

Introductory

The Elkhorn & Beaver Valley is a corporation of the State of Kentucky, having its principal office at Ashland, Ky. It is controlled by the carrier through ownership of the entire outstanding capital stock. The property of the Elkhorn & Beaver Valley has been operated by the carrier since completion.

Corporate History

The Elkhorn & Beaver Valley was incorporated on May 16, 1904, under the general laws of Kentucky. Its organization took place May 18, 1904.

Development of Fixed Physical Property

The owned mileage of the Elkhorn & Beaver Valley, extending from Beaver Creek to Wayland, Ky., a distance of 20.74 miles, was all acquired by construction, in 1913 and 1914, under supervision of the carrier. The road was constructed along the route previously surveyed and claimed by W. F. Hite, one of the incorporators and the first president of the Elkhorn & Beaver Valley and also an officer of the Beaver Creek Consolidated Coal Company, for the development of whose property the road was projected. Hite surrendered to the Elkhorn & Beaver Valley his claim for prior right of location of a line along Beaver Creek, upon the delivery to him of $30,000 par value of common stock, and under agreement dated June 11, 1911, between the Beaver Creek Consolidated Coal Company and the carrier, the latter assumed the construction of the road and the Beaver Creek Consolidated Coal Company transferred to the carrier, without cost, the $30,000 par value of common stock previously issued to Hite. Concurrently the Beaver Creek Consolidated Coal Company agreed to convey to the Elkhorn & Beaver Valley, without cost, the necessary right of way, of not less than 60 feet in width, through its lands and to secure and convey, also without cost, to the Elkhorn & Beaver Valley the necessary land for yard and station purposes at the mouth of Steel Creek.

Leased Railway Property

The property of the Elkhorn & Beaver Valley has been operated by the carrier since the date the road was opened for operation, under an agreement dated June 2, 1914, which extends for an indeterminate period. The consideration is equivalent to net income. No rental has been paid for the year ending during date of valuation.
