Dimitry Kochenov

Professor Dimitry Vladimirovich Kochenov leads the Rule of Law Workgroup at the Central European University Democracy Institute and teaches at the Department of Legal Studies. His research focuses on the principles of law in the global context, with a special emphasis on the Rule of Law, citizenship, and the enforcement of European Union values.[1]

Career

Prof. Kochenov is principal investigator on 'Rule of Law Practices' in the European Union's Horizon2020 RECONNECT consortium. Dimitry Vladimirovich sat on European Research Council Advanced grants panels, national research councils, and took part in the Portuguese Foundation for Science and Technology national research assessment of institutions of higher education. He sits on the editorial boards, inter alia, of the Hague Journal on the Rule of Law, Review of Democracy, Oxford Encyclopaedia of European Law, Vestnik Moskovskogo Universiteta Serija 11: Pravo and Review of Central and East European Law.[1]

Before returning to CEU Dimitry Vladimirovich was a professor in Groningen and held visiting appointments at Princeton University (Crane Fellowship in Law and Public Affairs at the Woodrow Wilson School and a Visiting Professorship at the University Center for Human Values); University of Oxford (COMPAS, School of Anthropology); NYU Law School (Émile Noël Fellowship); College of Europe (Visiting Professorship); University of Basel Institute for European Global Studies (Visiting Fellowship); Boston College (Senior Clough Fellowship), University of Turin (Visiting Chair in Private Law), LUISS Guido Carli (Rome, Visiting Co-Chair in EU Law), UNAM Mexico, Osaka Graduate School of Law and countless others.[1]

Controversy

Following a 2019 investigation[13] by Dutch news program Nieuwsuur into passport trade, University of Groningen conducted an investigation into Kochenov's paid consulting activities related to citizenship by investment or investment naturalisation, including his role with Henley & Partners and advising Malta on a law change to allow citizenship by investment.

In 2020, a University of Groningen investigation resulted in a warning but found that no breach of its conflict of interest rules had occurred.


Its main conclusions were that:

  • 'According to the investigators, Prof. Kochenov was not involved in any passport trade: he did not issue advice on individual cases and was not involved in the question whether individuals qualified for Maltese passports. His advice concerned components of the Malta Individual Investor Programme, partly in relation to EU regulations in the field of citizenship.
  • The investigators have not found indications that Kochenov’s academic independence and objectivity were affected as a result of payments made to him or for any other reasons.
  • In addition, no mention of Prof. Kochenov has been found in the Paradise Papers. The company on whose board he sat was listed, for the simple reason that all Maltese companies are listed in these papers.'[14]


Kochenov has received a mixture of criticism[15] and support[16] from academic colleagues on the matter of academic integrity.

Several months following the conclusion of the investigation Prof. Kochenov co-convened a Citizenship by Investment seminar at the University of Oxford[17] before leaving Groningen for the CEU.
