Fair use justification[edit]

It is believed that the copyright in the photograph has expired, or that use of the photograph in the article "John Foulds" is fair under the copyright law of the U.S., and of other jurisdictions where applicable, for the following reasons:

  • The image is not replaceable as the subject of the photograph died in 1939.
  • An image which does not rely on the doctrine of fair use is very difficult to obtain.
  • The image is smaller and of a lower resolution than the original photograph.
  • Use of the image in the article is unlikely to damage sales of the original, high-quality photograph.
