The photo was published in The Tribune (Scranton, PA) on July 23, 1981 (see [1]) without a copyright notice for the photo itself nor for the newspaper as a whole. There is no copyright registration for the column in which the photo appears nor for the newspaper as a whole. In fact, no columns in the entire newspaper had their copyright registered.
The photo was also published in The Morning News (Wilmington, Delaware) on July 23, 1981 (see [2]) without a copyright notice for the photo itself, but with a copyright notice for the newspaper as a whole. This version of the photo is used. However, out of an abundance of caution to avoid copyright violation, the photo has been cropped such that it does not include any part of the photo that was not published in The Tribune (i.e. the bottom portion has been removed).
