Fair-Use Rationale
[edit]I believe that this qualifies as fair-use for the following reasons:
- It does not infringe upon the rights of Gene McFadden nor John Whitehead.
- It does not infringe upon anyone who is in possession of the rights to their music.
- The duo was a mainly behind-the-scenes group, with few concerts.
- Very few existing mages are available, and virtually none are free.
- New ones cannot be created because both Mcfadden and Whitehead are deceased.
- The website soulwalking.co.uk sevres a similar function to Wikipedia. They appear to be in compliance with UK and US copyright laws, and the picture appears to be a personal photo provided by the duo to promote themselves.
- If there is any objection to the use of this image on Wikipedia, then whoever does own the rights to it may simply say so and request its removal.
Licensing
[edit]This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership.
