Size[edit]

I've reverted this to an image that satisfies general image size requirements to satisfy WP:NFCC. I'm not interested in edit-warring, but I am interested in compliance with image policy. You'd have to change the dimensions of every comic book cover image on Wikipedia, that have stood for years without legal challenges, in order to fully make your point. This image, which has been in place at current size on a featured article for nearly five years is a prime example. You would also have to change the infobox automatic skewing on every comic book article's page in order to keep the image well-rendered at the size you're reverting to. I'm prepared to do that, if necessary, but the WP:COMICS style guide seems pretty clear to me and WP:OTHERSTUFFEXISTS isn't an attractive argument. No fault of mine that multiple editors have chosen to ignore a Wikipedia fair-use guideline that overrides a project guideline, and even so, larger images are subject to case-by-case negotiation within that project guideline, not a general free-for-all. This can be fixed with a bot, if necessary, but the fact that images have persisted for however long is irrelevant- the point is that we do not take the risk of having an indefensible legal position. Well, you know from my User page that I've practised law in real life, and am fully conversant with the doctrine of precedent. As such, the nearest example I can imagine right now is adverse possession, in which legal rights to property are extinguished, but only if the otherwise owner of those rights is aware of the possession, and in this case, the fact that policy has been flouted for so long does not raise a presumption against the policy in the slightest. There are also many criminal offences, for example, that have not been prosecuted for many years but they remain crimes and do not become not-crimes because of a lack of recent examples. I am also well-versed in image fair-use policy here, having been an Admin for over two years, and looking at the WP:COMICS guideline, it is actually somewhat stricter than the general Wikipedia guideline, so if you want to tie your own hands by making an issue of it, please go ahead. My objective opinion is that the WP:COMICS project, with the best will in the world, will end up with egg on its collective face should it choose to get collectively involved.
