   1. It is impossible to create a free to use image as the subject is now deceased
   2. No public domain images have been created and it's reasonable to assume, given the circumstances surrounding the execution of Saddam Hussein, all images and footage of the execution are held under the copyright of the Iraqi Authorities.
   3. The image is to be used for critical commentary of the event

He isn't *actually* hanging in that photo. Suggest review of its description.

This is a historic picture and should have a good fai use rationale. I think the source is obvious from that TV --TheFEARgod (Ч) 16:48, 30 December 2006 (UTC)

    Ok, so it came from the channel. Now, as I stated elsewhere, I want to know what URL this came from. Once that is done, then we can worry about the fair use of this photo. I do agree that it is a historic photograph that cannot be recreated, the execution happened fairly recently and the AP and Reuters are selling these kinds of photos to their newspapers. If we host this now, but not later, we are cutting into the commercial value of the image. That fails one of the tests the US Government uses to determine if an image could be used under fair use or not. User:Zscout370 (Return Fire) 02:47, 31 December 2006 (UTC)

I'm glad to see the Iraqi government is classy enough to give their executioners ski masks. This looks just like a terrorist execution video; grubby clothes, badly cut black ski masks... c'mon, can't you afford executioners' uniforms? Titanium Dragon 18:03, 30 December 2006 (UTC)

    Unlike Sadaam (and terrorists for that matter), the new Iraqi government doesn't routinely execute people. Fast is better than pretty. --Tbeatty 18:56, 30 December 2006 (UTC)

[edit] Fair use in three articles?

I would like to kindly ask if we really have to claim fair use in three articles. Isn't it enough to use it at Execution of Saddam Hussein only? I consider that the best one to claim fair use unless a very good rationale is also available for uses at Saddam Hussein and Hanging. Chinese Wikipedia is discussing whether to delete a copy of this message.--Jusjih 16:34, 31 December 2006 (UTC)

[edit] HistoricImage template more appropriate?

I would have thought the (newish) {{HistoricImage}} copyright template would be better than the {{tv-screenshot}} used - which asserts "for identification and critical commentary on the station ID or program and its contents" which is not the case for the current usage. {{HistoricImage}} is similar to well used {{HistoricPhoto}}, but covers screenshots (and more) rather that Photos.             It's clearly an "historic event" even after 2 days, to my mind. The main {{HistoricImage}} assertion is "The Image depicts a non-reproducible historic event, and no free alternative exists or can be created", which to me seems true in this case. Whereas the {{tv-screenshot}} assertion "for identification and critical commentary on the station ID or program and its contents" is false for the current usage, so we need to change away from that somehow, or del the image (which I'm against).                 I support replacing the template. Deleting this image is unlikely at English and Chinese Wikipedia while both sites allow fair use of copyrighted images.--Jusjih 14:56, 1 January 2007 (UTC)

I've made the switch from {{tv-screenshot}} as it was wrong for current use of image. If someone can find a better template that {{HistoricImage}}, please make a further change. Rwendland 22:31, 1 January 2007 (UTC)
