Prefatory[edit]

This image is of a book, The Founding and Development of Modern Photography in Japan, edited by/for a 1995 exhibition at the Tokyo Metropolitan Museum of Photography and incorporating a photograph, Shiroi Hana ("White Flower") by Sakae Tamura. The design can be presumed to be © the Tokyo Metropolitan Museum of Photography, and the photograph © the estate of Sakae Tamura.

Although the picture is subject to copyright I (Hoary) think its reproduction where relevant is covered by the U.S. fair-use laws because:

  1. it is a low-resolution copy of a book cover;
  2. it does not in any way limit the rights or impede the efforts of the copyright owners to claim ownership of or derive income from the book or incorporated photograph;
  3. copies could not be used to make illegal copies of the artwork in any saleable form.-- Hoary 15:10, 5 August 2007 (UTC)

Fair use within Sakae Tamura (photographer)[edit]

The image is significant in the article on the photographer because it shows the photograph discussed within the article and demonstrates (by its selection for the cover of this cover for a catalogue of an exhibition of well over two hundred items) its significance as perceived by well-qualified curators. -- Hoary 15:10, 5 August 2007 (UTC)
