Summary
[edit]The image was produced prior to 1896 by Alfred Munroe, who died in 1904. The image was published in; Parks, Alva Moore. (1977) The Forgotten Frontier. Banyan Press. ISBN 0-916224-14-7. I do not know if it was published prior to 1977. The book includes a notice that all images in the book are copyright 1977 by the Historical Association of Southern Florida. The image was retrieved from the University Of Miami's Rosenstiel School of Marine and Atmospheric Science web site. Hunter Augustus of the Rosenstiel School told me in an e-mail, "Yes it's in the public domain - it would be nice to mention the source but that's up to you. Use it in good health. I do not know the background."
Fair use rationale for Houses of Refuge in Florida
[edit]1. The photo is of a building that does not exist anymore. The only other known photo of the building was taken after it had been modified, sometime after 1915. The only surviving structure of this design, the House of Refuge at Gilbert's Bar in Stuart Florida, has been extensively modified, largely hiding its original appearance.
2. Commercial opportunities for the use of this image appear remote.
3. This image is used in only one article.
4. The image has been published in a book and on the web.
5. The image meets content requirement and is encyclopedic (it depicts a historic type of structure).
6. The image meets the image-use policy.
7. The image is used in one article.
8. Use of the image will give readers a better understanding of the construction and use of the houses of refuge that were constructed in Florida in the 1870s.
9. The image is used only in an article.
