Though this image is subject to copyright, its use is covered by the US fair use laws because:

1. It illustrates an educational article about the only album relesased by this artist.
2. The image is used as the primary means of visual identification of the article topic.
3. This image is small and low-resolution, suitable only for recognition of the album cover but unusuable for commercial purposes. In particular, copies of the image could not be used to make illegal copies of the album artwork on another CD.
4. The image is only a small portion of the commercial product.
5. It is not replaceable because a picture of album artwork necessarily resembles the album artwork. Anothe rpicture would not illustrate what the album looks like.
