PD-OLD-50. Old Image and Indian Laws:

  • This image is of Indian origin and is about a 100 years old, and the Indian Copyright Laws from the period dictates that any photograph automatically becomes public domain property after 50 years. American Copyright Laws would accpet it as a public domain image for reasons stated below.

Anonymous Author and Presumed Death:

  • This image was authored by one of the disciples of en:Sri Anandamoyi Ma who was never identified later. But, the historical context (i.e. presumed age of someone able to take a photograph in India almost a 100 years back, life span of Indian people etc.) dictates that it is safe to presume that the person has died even before WWII.

Use and Circulation:

  • It is fairly well-circulated among the followers of the subject as a public domain image, and is being used on the article en:Sri Anandamoyi Ma solely on educational purpose.

The Indian Copyright Act, 1957 is not retroactive, so any work in which copyright did not subsist when it commenced did not have its copyright restored, and is in the public domain per the Copyright Act 1911.
