Legally the office might be considered "vacant" (we can not know, since original research is banned, and we can not ask anybody about it), but "to perform the duties of" and "to act as" are SYNONYM in the English language, and the New York Times has called all temporary senate presidents who performed this duty after the originally elected Lt. Gov succeeded to the governorship (not acted as governor; Paterson is Governor, not Acting Governor!) "Acting Lieutenant Governors" (Hanley, Wicks, Mahoney, Anderson).
