- ^ Amendment 1 of the WV Constitution, adopted in 1904, expanded the Court to five seats effective in 1905 and, unlike in 1872, did not require new elections for all seats. For the interim, the amendment permitted the Governor to appoint the vacancy.[2]
- ^ Though Judge Recht had resigned, the Court issued an Administrative Order on the same date temporarily appointing him until Dec. 18, 1996.
