Michaelquinn32 Usage is governed by Kazakhstan's law "On Trademarks." The law is in Russian, unfortunately, but this sticks out in the first section "The owner of the trademark has a right to use it in any matter he sees fit." http://translate.google.com/translate?hl=en&sl=ru&tl=en&u=http%3A%2F%2Fwww.kazpatent.kz%2Facts%2Flaw%2Ftrade_mark_law.html

I believe that the use of this non-free image in the article Rated R (Queens of the Stone Age album) is fair because:

  1. No free or public domain images can be created for this album cover.
  2. The image does not limit the copyright owners' rights to distribute the album in any way.
  3. This image is widely distributed in other venues, so its use on Wikipedia does not make it significantly more accessible or visible than it already is.
  4. The cover is being used for educational and informational purposes only, and its use is not believed to detract from the original album in any way, or deprive its copyright holders of any financial gain.
  5. The image is of lower resolution than the original cover. Copies made from it will be of inferior quality, and could not be used as artwork on illegal CD copies of the album.

The only known record of any the Apache scouts, with the exception of William Alchesay, was during George Crook's campaign in 1872-73 (see Above and Beyond: A History of the Medal of Honor from the Civil War to Vietnam).
