The Conformity Certificate of the Customs Union.

In order to provide the Russian citizens with safety of life and health many kinds of production must have proof of conformity in different certification systems. For that purpose different means of certification are used:

declarations; conformity certificates; certificates of state registration; other kinds of documents.

Nowadays the main controlling structure on the territory of Russia is Gosstandart. But as many norms that earlier were required to production from the RF GOST were developed many decades ago they often do not meet the modern requirements any more.

The need for the Certificate

With this connection, after the Customs Union was founded, the operation of controlling many goods saw a number of changes. The newly appeared procedure is performed in accordance with the Technical Reglaments. The similar normative acts are drawn up with consideration of needs of recent customers on the base of international standards. Development of Technical reglaments is performed by the Commission of the CU. Nowadays there are the normative only for certain categories of production. Nevertheless, in the future it is planned to enforce in the countries of the Customs Union certification procedures on the base of the Technical Reglaments only.

The Goal of the Certificate

The goal of such radical changes is the more quality and poly-aspect research of the produced and realized production as well as creation the unified trading zone on the territory of certain states. Such kind of changes must meet not only customer’s interests, but also the interests of the production manufacturers. The advantage of such document as the Customs Union certificate is that it may be used in any state that is a member of the Customs Union. It allows open wide perspectives for the manufacturers by organizing business, because due to such a document there is a possibility of transportation of the production on the territory of the CU without paying the customs tax and without complex customs procedures.

The Documents Needed

In order to receive the Customs Union Certificate it is necessary to apply the certification center that is authorized and to go through the procedure of control consisting of the following stages:

applying; performing the obligatory researches of the production in the authorized laboratories.; expert evaluation of the presented documentation; matching the results of testing the goods with the requirements of the Technical Reglaments; making decision about the goods conformity to all the requirement that it must conform; the applicant receives the Certificate of the Customs Union only after the positive decision or he may get refusal to draw up the document.

It should be noted that the Customs Union Certificate is a quite important certification document which is obligatory for any kind of production. After drawing up such a paper, entrepreneurs are allowed to legally manufacture their production, to perform its transportation and realization on the whole territory of the Customs Union.

The Detailed Description

The CU Conformity Certificate may be replaced by a national permissive document.


The Legislation of the Customs Union started its action in 1 July 2012. At the initial stage the evaluation of conformity was performed within the frameworks of the unified sanitary rules of the CU. But already at that time it was possible to draw up the voluntary Customs Union Conformity Certificate. On the 7th of April 2011 there was a decision by the KTS № 620 that approved the list of the production for obligatory certification with drawing up the unified Customs Union Conformity Certificate.

The Customs Union Conformity Certificate may be drawn up in the body of conformity evaluation that is authorized within the national certification system and included into the state registry of the CU certification bodies. The procedure of drawing up of such a permissive document is usually initialized by the applicant himself by applying to the CU certification body. Also it is obligatory to enclose the documents required in accordance with the legislation and the samples of production if the goods have not gone through the laboratory research.

The certification tests are performed on the base of the contract between the applicant and the testing laboratory that has the National Attestation of Accreditation for performing the certification researches of the required kinds of production listed in the state registry of the research laboratories of the CU and that have the right to perform the measurements by drawing up the unified Conformity Certificate of the Customs Union.

The specialists of the certification body provide assistance to the applicant in selecting the appropriate according to the CU legislation scheme of proving conformity of the production. Next, they perform the analysis of the documentation presented to the certification body; they make sure in its sufficiency, absence of controversies and correctness of all the stated information.

On the base of the certification researches protocol of the certification body the expert makes a conclusion about the conformity or unconformity of the evaluated production to the certain requirements of the KTS № 620 decisions. Along with this the protocol of tests must include the actual indicators of all the characteristics that are required for proving in accordance with the regulating document. If the expert makes sure that all the actual characteristics of the researched indicators conform the frameworks of the limits, in this case he may make conclusion of Conformity of the production to the requirements of the CU legislation and to draw up the unified CU Conformity Certificate.


Then comes the state of the state registration of the CU Conformity Certificate in the unified registry of the given permissive documents. Only it’s entering into the unified list and giving it the registration number means the final stage after which comes the transfer of the CU Conformity certificate to its owner.

The validation term of the unified Customs Union Conformity Certificate depends on the selected scheme of evaluating conformity proof, on the kind of production, presence or absence at the applicant-manufacturer the certificate of the system of management in the enterprise that proves its obeying to the requirements of the ICO 9010 standards and other factors.

The unified forms of the permissive documents of the CU were approved by the decision of the KTS № 563 of 2nd March 2012. In the frameworks of the given regulating documents there is an approved unified Customs Union Conformity Certificate and the unified CU declaration.

The customs legislation means the possibility of replacing the procedure of receiving the unified Customs Union Conformity Certificate by drawing up the permissive document within the frameworks of the national certification system, acting on the territory of the Union.

But it should be taken into consideration that the CU legislation provides a number of details important for the applicant in comparison with the permissive documents drawn up in the system of obligatory state certification of the RF GOST R.


The unified Customs Union Conformity Certificate acts on the territories of all three states of the Union, while the permissive national documents allow the production the right of the legal turnover only on the territory of the country where the certificate was drawn up. In the case of the GOST R I is the territory of the Rf. The CU conformity Certificate may be drawn up for the serial production for the period up to 5 years. But the GOST R certificate has the maximum term of action – 3 years.


The unified Customs Union Conformity Certificate as well as the national conformity certificates may be drawn up as well as in obligatory form ( for the production included into the decisions of the KTS № 620) and on the voluntary base for any kind of production including the goods for which it is necessary the obligatory CU Conformity Certificate.


If the production requires obligatory drawing up the CU Conformity Certificate so the given condition covers not only the production manufactured in the Union countries but for the foreign goods too. Along with this if the Russian issuer of the Unified Customs Union Conformity Certificate for the goods by its import into the CU countries, there is no necessity to draw up the additional conformity certificate.

By importing into the territory of the countries members of the Union of foreign goods the CU Conformity Certificate is obligatory till the moment of crossing the border of the Customs Union.


It will be obligatory to draw up the CU Conformity Certificate for different kinds of production until there is the CU legislation introduces it in the form of Technical Reglament.
