It is believed that the depiction of the copyrighted sculpture "Clock of Nations" shown here is permissible due to either being de minimis -- too minor an element to be considered a copyright violation -- or else fair use. If the latter, the rationale for use of this image on the Midtown Plaza (Rochester) article is that any depiction of the atrium of this mall would, by necessity, have included the Clock of Nations; it was impossible to take such a picture without incorporating the clock. The amount of the copyrighted sculpture used is minimal, depicting only a portion of the sculpture and in sufficiently low resolution.
