Allegations have been made that the 2023 Israel–Hamas war constituted a genocide against the Palestinians.[1][2] Many scholars have cited numerous Israeli statements which they argue constitute an "intent to destroy" the population of Gaza, a necessary condition for the legal threshold of genocide to be met.[3] As of 22 December 2023, more than 21,000 Palestinians, including over 8,000 children, 6,200 women and 61 journalists have been killed, nearly as many killed as in the Rohingya genocide.[4] It is estimated that thousands more bodies were buried under the rubble.[5][6][7]

Background

After the 7 October attacks by Hamas, Yoav Gallant, Israeli Minister of Defense, stated “We are fighting human animals, and we are acting accordingly,”.[8] Avi Dichter, Israeli Minister of Agriculture, called for the war to be a “Gaza’s Nakba” on Channel 12.[9] Amihai Eliyahu, Israeli Minister of Heritage, called for dropping an atomic bomb on Gaza.[9] President of Israel Isaac Herzog blamed the whole nation of Palestine for the 7 October attack.[10]

Major General Ghassan Alian, Coordinator of Government Activities in the Territories, "There will be no electricity and no water (in Gaza), there will only be destruction. You wanted hell, you will get hell,".[8] Republican member of the Florida House of Representatives, Michelle Salzman, stated in the house that the death of everyone in Gaza would be enough in response to a rhetorical question.[11]

Norman Finkelstein has claimed Benjamin Netanyahu calling the Palestinians Amalek was a call for genocide.[12] He accused Israel of engaging in a "genocidal war".[13] Raz Segal called the war a “textbook case of genocide.”[10] This was refuted by Professor David Simon and Ben Kiernan of Yale University.[10]

South Africa approached the International Court of Justice under the Geneva convention to investigate Israel over allegations of genocide, war crimes and crimes against humanity.[14] South Africa's president Cyril Ramaphosa compared Israel's actions to apartheid.[15] Israel denied the allegations and accused South Africa of working with Hamas.[14] Israel called the actions of South Africa blood libel.[16] On 2 January 2024, Israel decided to appear before the ICJ in response to the case made by South Africa that Israel was committing genocide.[17]

Euro-Mediterranean Human Rights Monitor documented evidence of execution committed by Israeli Defense Forces.[18] It submitted the evidence and documentation to the International Criminal Court and the United Nations special rapporteur.[18]
