Such sites host a mixture of content created by the US federal government (public domain) and content created by businesses and private individuals (a wide variety of free and unfree licenses). For many years, hosting such images on the Commons was done in good faith under the rationale that:
An extensive review of this rationale in 2024 revealed that neither of these beliefs held up to scrutiny. These findings were confirmed in an RfC conducted from August to October 2024. Per COM:ONUS it is the responsibility of the person uploading an image to the Commons or anyone arguing for its retention here to provide evidence of permission from the copyright holder. This particular image is the work of noted Florida photographer Gleason Waite Romer (1887-1971). It is part of a collection of images that the City of Miami purchased from Romer in 1965.[1] The Miami-Dade Public Library System, which holds this collection of images in its archive, claims that it is still under copyright. There is no evidence that this photograph was ever published prior to 1989, meaning that copyright exists until 70 years after the creator's death (2042). Without any evidence that copyright was divested or expired, we must delete this image as a precaution.
