Fair Use rationale for Ed Birchall. This is a television screen shot from a 1980s KOCO archive of HO-HO the clown, a deceased entertainer otherwise known as Ed Brickall. The face and costume will be instantly recognizable to anyone who was in his broadcast audience, and is necessary for identification as very few people are familiar with his real name and there are multiple "HO HO" clows throughout America. The purpose of the copyrighted television material was to educate children and secondly to generate a local television audience (the show had no advertising during this period). The copied portion is as small as possible, a single screen frame, and is unlikely to substitute or interfere with the market for his live action show.
