O Ministério da Cultura, por meio do Instituto do Patrimônio Histórico e Artístico Nacional (Iphan), homologou o tombamento de um conjunto de 27 obras do arquiteto Oscar Niemeyer, localizadas em Brasília, Rio de Janeiro e São Paulo.

As obras passam agora a ser protegidas pelo Iphan como Patrimônio Cultural Brasileiro. São elas: o Museu da Cidade, o Espaço Lúcio Costa, o Panteão da Liberdade e Democracia, o Teatro Nacional, o Memorial JK, o Memorial dos Povos Indígenas, o Conjunto Cultural Funarte, o Espaço Oscar Niemeyer, o Conjunto Cultural da República, o Edifício do Touring Club do Brasil, a Praça dos Três Poderes, a Casa de Chá, Pombal, o Palácio da Justiça, o Palácio Itamaraty e anexos, a Capela Nossa Senhora de Fátima, o Conjunto do Palácio da Alvorada, o Congresso Nacional, o Palácio do Planalto, o Supremo Tribunal Federal, os prédios dos Ministérios e anexos, o Quartel General do Exército, o Palácio Jaburu, todos esses localizados em Brasília (DF).

Além dos bens listados na capital federal, estão protegidos também a Casa das Canoas (RJ), o Conjunto da Passarela do Samba (RJ), o Museu de Arte Contemporânea (RJ), o Conjunto do Parque do Ibirapuera – especificamente, a Grande Marquise, o Palácio das Nações (Pavilhão Manoel da Nóbrega), o Palácio dos Estados (Pavilhão Francisco Matarazzo Sobrinho), o Palácio das Indústrias (Pavilhão Armando de Arruda Pereira), o Palácio de Exposições ou das Artes (Pavilhão Lucas Nogueira Garcez, conhecido como "Oca") e o Palácio da Agricultura (SP).

The photographical reproduction of this work is covered under the article 48 of the Brazil copyright law, which states: Works permanently located in public places may be freely represented by painting, drawing, photography and audiovisual processes.

Warning: FoP is allowed in Brazil, including commercial use, to some extent. Artworks placed in locations with access to the public can be freely represented by photography, painting, drawing and audiovisual means. Commercial use is allowed, as long as the artist's work is properly attributed, the representation does not consist in a reproduction. The existing jurisprudence consistently allows commercial use of artworks under FoP, as long as the artwork is accessory, and not detached from its surrounding elements, and therefore not unfairly used to produce revenue that by law belongs to the artist. Violation of those rights is frequently punished by Brazilian courts with pecuniary indemnisations to the offended party.
