The entire cover: because the image is cover art, a form of product packaging, the entire image is needed to identify the product, properly convey the meaning and branding intended, and avoid tarnishing or misrepresenting the image.

Low resolution?

The copy is of sufficient resolution for commentary and identification but lower resolution than the original cover. Copies made from it will be of inferior quality, unsuitable as artwork on pirate versions or other uses that would compete with the commercial purpose of the original artwork.

Purpose of use

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It is a low resolution image, and thus not suitable for production of counterfeit goods.
  2. The logo is not used in such a way that a reader would be confused into believing that the article is written or authorized by the owner of the logo.
  3. It is of historical significance for this person and in the history of ambigrams. The logo used in the album artwork is the first published ambigram by the person the article is about.
  4. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value. Replacing it with a different logo would not have the same value.
  5. It is already on Wikipedia in the On Earth as It Is in Heaven article, so its additional use here does not cause any additional infringement, if there is anyway. By using the album artwork instead of the logo by itself (or another logo by this artist), we avoid uploading an additional copyrighted image to Wikipedia.
