I Fhsdtrh feel it is covered by the U.S. fair use laws because:
- It is used to illustrate the musician in question
- It has no limitations for the copyright owner to sell the photo
- There is no other available image available
- In no way could copies be used to make illegal duplications of the photo for any other reason
