According to the old Swedish photography copyright law (1960:730), the orderer of a portrait in dubio has got the copyright to the portrait (14 § 1 section). Even if the photographer has reserved the right to the portrait, the orderer has the right to insert the portrait into a "newspaper or periodical publication or writing with biographical contents" (14 § 2 section). Accordning to the government bill "articles about persons, in encyclopaedias" are such biographical writings (His Royal Majestys bill n:o 17 year 1960 p 345). These regulations are applicable if the portrait is made earlier than the 1 July 1994, and rights procured earlier than this date are still valid, according to the new regulations (law 1994:190). |
