Fair use?

I didn't know wikipedia let photos like this be used under fair use. I've had photos booted for less. Is someone getting away with something here? Don't have time to figure it out myself. CarolMooreDC (talk) 14:18, 21 December 2008 (UTC)[reply]

IMHO in the article Mahmoud Ahmadinejad and the 1979 Hostage Crisis it could be considered fair use, yet in the article Iran hostage crisis it should not as its use is not transformative in nature and discusses events it depicts rather than the photograph.
