Isn't this Public Domain?[edit]

In accordance to § 313.6(C)(2), shouldn't this be public domain? It might not, but from a basic understanding, it seems to apply. Evenite (talk) 23:09, 2 April 2023 (UTC)[reply]

IANAL, but my lay understanding (having read that section of the Copyright Act for the first time just twenty minutes ago) is that flags of US cities probably would not meet the definition of "government edict" in the narrow sense, so it doesn't seem like they are uncopyrightable as a rule. Particularly not this graphic, which, according to the city was only used in unofficial capacities. Evidently, the Pocatello Chamber of Commerce believed the graphic was copyrighted when they made it, and that alone was my rationale for restoring it as NFC.
