How can the photographer be sure this is a salaryman and not just any other man that simply wears a suit because of a special occasion? This is defamatory, despite the blurred face.

It's his handkerchief. I took the photograph -- the hanky was in his hand as he slept and slumped over further, and as the commute wore on the hanky slipped from his hand and fell onto the floor.
