Herbert died in 1646.[1]

Herbert married firstly Priscilla Pigot, daughter of Sir Edward Pigot of Laughton, Buckinghamshire and secondly Elizabeth Claypole daughter of Sir John Claypole of Northamptonshire. His son Henry Herbert was also MP.[1]
