It is a low resolution copy of a promotional photograph;
It does not limit the copyright owner's rights to distribute the photograph in any way;
The work is of a picture by the member of the band in question, namely American Head Charge;
No free alternative photographs can be found since the person in question is deceased;
The deceased band member died while the group was on tour, and was a media talking point for awhile;
Scanned copies could not be used to make illegal copies of the photograph.

Licensing
