- ^ a b c d e f g In 1872, the new State Constitution expanded the Court to four seats requiring new elections for all seats. It also permitted former C.S.A. supporters to serve.[1]
- ^ Amendment 1 of the WV Constitution, adopted in 1904, expanded the Court to five seats effective in 1905 and, unlike in 1872, did not require new elections for all seats. For the interim, the amendment permitted the Governor to appoint the vacancy.[2]
