Key case?

[edit]

What's the basis for that characterization that this was a "key case" of the PCIJ in general? IMHO (talk) 02:00, 6 June 2013 (UTC)[reply]

Parties to the case

[edit]

I just wanted to explain some of the changes I made. The PCIJ never takes an appeal, as from a national court. The government of one state brings a case against the government of another state. Although the treatment of one state's citizens by the courts of another state may be the subject of the case, it is still not an appeal of the state's own court cases. Also, the issue is ultimately whether one state violated obligations to another state, however, diplomatic protection is a recognized base for state to claim the certain legal injuries to one of it's citizens consitutes an injury to the state itself.
