Swartz Creek, Michigan uses a council-manager form of city government. The council hires a chief administrative officer with the title of city manager to handle day-to-day administration.[1] Together with Clayton Township the city runs a joint volunteer fire department, Swartz Creek Area Fire Department with two fire stations, one per municipality.

Council

The council has seven members, three are elected at-large and four are elected from the city's 4 precincts, or districts. There is only one ward. Council members serve four year terms with the precinct class and the at-large class staggered two years apart in even years. The City's mayor and mayor pro-tem are selected from amongst the Council's members.[1] Originally, both classes of council members were elected for two year terms until a charter amendment to allow Councilors to serve 4 year terms with at-large and precinct class elected at staggered 2 years apart beginning in November 1978.[2]

Judicial

The city charter allow for the election of a Justice of the Peace.[1] Justice of the Peace was discontinued by the Judicial reorganization mandated by the last adopted Michigan State Constitution that unified the Judicial system.[11]

The Swartz Creek Area Fire Authority (d.b.a. Swartz Creek Area Fire Department) is a joint on call fire department for the City of Swartz Creek, Michigan and Clayton Township. The Department is governed by a seven member board. The Fire Board is composted of seven board members with one elected official and two citizens representatives from each participating municipality. Each of these representatives serve three year terms. An At-large board member with a 1 year term is chosen alternatively by the City and Township. The fire chief is an ex officio member with out the right to vote.

History

In 1925, the Swartz Creek Community Fire Association was formed but by 1952 was forced to dissolve and handed over to the two townships, Clayton and Gaines. Clayton and Gaines then reformed it as a shared department of both townships. The City of Swartz Creek was incorporated in 1959 from parts of Clayton and Gaines Townships thus becoming a member of the shared department.[12] Gaines Township withdrew from the Department on April 1, 1980 starting its own department. [13] Under the 2009 renewed agreement between Clayton and Swartz Creek, the Department name was changed from Swartz Creek Area Fire Department to Swartz Creek Area Fire Authority with a 'doing business as' assumed name of Swartz Creek Area Fire Department.
