Summary
[edit]It is a photo of the monument "Defenders of the Soviet Arctic during the Great Patriotic War" in Murmansk. It is taken from the Russian Wikipedia, here and the license info is there. The photo has been released under Creative Commons Attribution-Share Alike 3.0 by the person who (says he) took the picture, Russian Wikipedia user V1P3R. However, in Russia, photos of public installations are not free except for noncommercial use -- so this photo can't be on Commons (and probably shouldn't be on the Russian Wikipedia, I think). And for just the photo itself:

Well, the article is about the statue. Having a picture of the statue is pretty central to the gist of the article, I would say. |
Replaceable? |
It's not replaceable, no. The objection is around freedom-of-panorama and any other photo would have the same problem. I suppose it could be replaced by a drawing. |

As such it is a derivative work of art, and per US Copyright Act of 1976, § 106(2) whoever holds copyright of the original has the exclusive right to authorize derivative works. Just want to point out 1) this applies only to the PHOTO, not the SUBJECT, and 2) "I" am not the copyright holder -- the person who originally uploaded it to the Russian Wikipedia is.
