Nevada has laws decriminalizing cannabis possession for adults age 21 and over; non-medicinal cannabis possession remains a felony with a minimum one-year and a maximum four-year prison sentence for adults under age 21. Thus, Nevada is not considered to have fully decriminalized marijuana.[1] Maryland has an active medical marijuana program, but this is really an affirmative defense law rather than an active program. 1. ↑ Note on Nevada: Possession of less than an ounce of marijuana by minors and adults under 21 is a class E felony in Nevada with a one year mandatory minimum prison sentence. However, first time older adult offenders receive a misdemeanor and a fine not exceeding $600.[1]
2. ↑ Note on Maryland: "Maryland's legislature passed a medical marijuana affirmative defense law in 2003. This law requires the court to consider a defendant's use of medical marijuana to be a mitigating factor in marijuana-related state prosecution. If the patient, post-arrest, successfully makes the case at trial that his or her use of marijuana is one of medical necessity, then the maximum penalty allowed by law would be a $100 fine."[2]
