"This is a photograph or other kind of depiction of a copyrighted, three-dimensional creative work, such as a statue or work of architecture. The article contains a discussion of that work which requires illustration. The photograph as such is free, or was provided by the creator of the sculpture." That's one of the criteria presented when uploading non-free files. This image meets that criteria. (Except the last sentence, which seems tacked on and contradicts the rest of the passage. The photograph isn't free -- can't be, the statue is in Russia -- but we're justifying fair use here. The creator of the sculpture is dead, so he's going to be hard-pressed to provide anything. FWIW, the Russian person who took the picture released it under cc-by-sa-3.0, but he didn't have the right to do that when publishing it in Russia which is where he did. If he had published it on the English Wikipedia he could have. But his release indicates that he'd have no objection to us publishing it here, if that matters. Although the original picture is released under a Creative Commons Attribution 3.0 style license, the image can only be used under the fair-use provisions on Wikipedia, because it is a photograph of a copyrighted work (and could thus be considered derivative), where the original work is situated in a jurisdiction that does not recognise freedom of panorama for public artworks. |

As such it is a derivative work of art, and per US Copyright Act of 1976, § 106(2) whoever holds copyright of the original has the exclusive right to authorize derivative works. Per § 107 it is believed that reproduction for criticism, comment, teaching and scholarship constitutes fair use and does not infringe copyright. It is believed that the use of a picture
qualifies as fair use under the Copyright law of the United States. Any other uses of this image, on Wikipedia or elsewhere, might be copyright infringement. | |
